1) Scope of Application
1.1 These General Terms and Conditions (hereinafter "T&Cs") of LX8 (hereinafter "Seller") apply to all contracts for the supply of goods concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding the goods displayed in the Seller’s online shop. The inclusion of the Customer’s own terms is hereby objected to, unless otherwise agreed.
1.2 These T&Cs shall also apply to contracts for the supply of vouchers, unless expressly otherwise agreed.
1.3 A consumer within the meaning of these T&Cs is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.4 An entrepreneur within the meaning of these T&Cs is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade, business, or profession.
2) Conclusion of Contract
2.1 The product descriptions in the Seller’s online shop do not constitute binding offers but serve as an invitation for the Customer to submit a binding offer.
2.2 The Customer can submit an offer via the integrated online order form. By placing the selected goods in the virtual shopping cart, going through the electronic order process, and clicking the button that concludes the order process, the Customer submits a legally binding contractual offer.
2.3 The Seller may accept the Customer’s offer within five days by:

sending a written or electronic order confirmation (fax or email), in which case receipt of the order confirmation is decisive, or
-
delivering the ordered goods, in which case receipt of the goods is decisive, or
-
requesting payment from the Customer after the order is placed.
If several of these alternatives apply, the contract is concluded at the time the first alternative occurs. The period for acceptance begins the day after the Customer’s offer is sent and ends at the close of the fifth day. If the Seller does not accept the offer within this period, the offer is deemed rejected and the Customer is no longer bound.
2.4 When choosing a PayPal payment method, processing takes place via PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, under PayPal’s terms of use (https://www.paypal.com/webapps/mpp/ua/useragreement-full). If the Customer does not have a PayPal account, the terms for payments without a PayPal account apply. Acceptance of the Customer’s offer occurs immediately when the payment is confirmed.
2.5 When selecting Amazon Payments, processing takes place via Amazon Payments Europe s.c.a., Luxembourg, under Amazon’s user agreement (https://payments.amazon.de/help/201751590). By confirming payment, the Customer simultaneously issues a payment instruction to Amazon, and the Seller accepts the offer at this point.
2.6 The Seller stores the contract text and sends it to the Customer in text form (email, fax, or letter) after submission. Beyond this, the Seller does not provide further access to the contract text.
2.7 Before submitting the order, the Customer can identify and correct input errors using common keyboard and mouse functions and the browser zoom tool until the final order button is clicked.
2.8 The contract language is German.
2.9 Order processing and communication generally take place via email. The Customer must ensure that the provided email address is correct and capable of receiving Seller communications.
3) Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Detailed information on the right of withdrawal is provided in the Seller’s cancellation policy.
4) Prices and Payment Terms
4.1 Unless otherwise indicated, prices shown are total prices including statutory VAT. Shipping costs, if applicable, are listed separately.
4.2 For deliveries outside the EU, additional costs may apply (e.g., bank transfer fees, import duties, or taxes), which the Seller does not control and which the Customer must bear.
4.3 Available payment methods are communicated in the Seller’s online shop.
4.4 If advance payment by bank transfer is agreed, payment is due immediately unless otherwise specified.
4.5 Payments via PayPal are processed directly with PayPal or associated providers. For certain methods like invoice or installment, PayPal may perform credit checks and the Seller reserves the right to deny the method if the result is negative.
4.6 For SOFORT payments, processing is via SOFORT GmbH, Munich (https://www.klarna.com/sofort/). The Customer must have an active online banking account.
4.7 Payments via Shopify Payments are processed via Stripe Payments Europe Ltd., Dublin (https://www.shopify.com/legal/terms-payments-en). Stripe may involve additional providers with their own conditions.
4.8 For credit card payments via Stripe, payment is due immediately upon contract conclusion. Stripe reserves the right to conduct credit checks and may decline the method.
5) Delivery and Shipping Conditions
5.1 Delivery is made to the address specified during order processing within the Seller’s stated delivery areas.
5.2 If delivery fails due to Customer fault, the Customer bears resulting costs. Exceptions apply if the Customer validly exercises the right of withdrawal.
5.3 For entrepreneurs, risk passes upon delivery to the carrier. For consumers, risk passes only upon actual receipt unless the Customer arranges their own carrier.
5.4 The Seller may withdraw if not supplied correctly by their own suppliers, provided the Seller acted with due care. In such cases, the Customer will be informed immediately and any payments refunded.
5.5 Self-collection is not possible for logistical reasons.
6) Retention of Title
The Seller retains ownership of the goods until full payment is received.
7) Liability for Defects (Warranty)
7.1 For entrepreneurs:

The Seller chooses the type of supplementary performance.

Limitation for new goods is one year; used goods are excluded from warranty.

Limitation does not restart upon replacement delivery.
7.2 Exceptions: The above does not apply to claims for damages, fraudulent concealment, goods used in construction, or obligations to provide digital updates.
7.3 Statutory recourse claims remain unaffected.
7.4 For consumers: Customers are requested to report visible transport damage but failure to do so does not affect legal rights.
8) Special Conditions for Processing Goods According to Customer Specifications
8.1 Where the Seller processes goods per Customer instructions, the Customer must provide lawful content and grant necessary rights. The Customer is fully responsible for any violations of third-party rights.
8.2 The Customer indemnifies the Seller from third-party claims arising from submitted content and bears related legal defense costs.
8.3 The Seller reserves the right to reject processing orders that violate laws, regulations, or public decency (e.g., racist, offensive, or violent content).
9) Redemption of Gift Vouchers
9.1 Gift vouchers can only be redeemed in the Seller’s online shop.
9.2 Vouchers and balances are valid until the end of the third year after purchase.
9.3 Vouchers can only be applied before checkout; retroactive use is excluded.
9.4 Only one voucher can be redeemed per order.
9.5 Vouchers cannot be used to purchase other vouchers.
9.6 If the voucher value is insufficient, the balance must be paid via other payment methods.
9.7 Voucher balances are not paid out in cash and do not accrue interest.
9.8 Vouchers are transferable. The Seller may discharge obligations by honoring the voucher for whoever redeems it, unless the Seller is aware of lack of authorization or capacity.
10) Governing Law
All legal relations shall be governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice applies only insofar as it does not deprive them of mandatory protections in their country of residence.
11) Alternative Dispute Resolution
11.1 The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
11.2 The Seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
